1. Introduction

Welcome to Bayview Therapy ("we," "us," "our"). These Terms and Conditions ("Terms") govern your use of our website at bayviewtherapy.com and all related services, including but not limited to appointment scheduling, contact forms, SMS/text messaging, and client communications. By accessing our website or using our services, you agree to be bound by these Terms.

Bayview Therapy is a counseling and psychology practice with offices in Fort Lauderdale, Coral Springs, and Plantation, Florida.

2. Services

Bayview Therapy provides mental health counseling and psychological services, including individual therapy, couples and marriage counseling, family therapy, teen and child therapy, psychological testing, EMDR, and related services. All clinical services are provided by licensed therapists and psychologists.

Information provided on our website is for general informational purposes only and does not constitute medical advice, diagnosis, or treatment.

3. Appointments and Cancellations

By scheduling an appointment through our website, phone, or any scheduling platform, you agree to our appointment and cancellation policies as communicated to you during the intake process. A minimum of 24 hours' notice is required for cancellations or rescheduling. Late cancellations or no-shows may be subject to a fee.

4. SMS/Text Messaging Terms & TCPA Consent

4.1 Consent to Receive Messages

By providing your phone number to Bayview Therapy — whether through our website contact form, intake paperwork, appointment scheduling, or direct communication — you expressly consent to receive SMS/text messages from Bayview Therapy at the phone number you provided. These messages may include:

• Appointment reminders and confirmations

• Follow-up communications related to scheduling or care coordination

• Practice notifications such as office closures, schedule changes, or important updates

• Reengagement messages if you previously contacted us about services but have not yet scheduled an appointment

4.2 Message Frequency

Message frequency varies. You may receive up to 5 messages per month depending on your engagement with our practice. Message and data rates may apply depending on your mobile carrier and plan.

4.3 Opting Out

You may opt out of receiving text messages at any time by replying STOP to any message you receive from us. Upon receiving your opt-out request, we will confirm your removal and you will no longer receive SMS messages from Bayview Therapy unless you re-consent.

4.4 Opting Back In

If you previously opted out and wish to receive text messages again, you may reply START to any previous message from us or contact our office directly at (954) 391-5305 to re-consent.

4.6 Carriers and Liability

Bayview Therapy is not responsible for delayed or undelivered messages due to carrier network issues, device incompatibility, or other factors outside our control. Supported carriers include but are not limited to AT&T, Verizon, T-Mobile, and Sprint.

4.7 No SMS for Clinical Content

We will never send protected health information (PHI), clinical notes, diagnoses, or treatment details via SMS. Text messages are limited to administrative and scheduling communications only.

4.8 TCPA Compliance

Bayview Therapy complies with the Telephone Consumer Protection Act (TCPA) and all applicable federal and state regulations regarding electronic communications. We do not send unsolicited text messages. All SMS communications are initiated based on your prior express consent, an existing client relationship, or your direct inquiry to our practice.

Your consent to receive text messages is not a condition of purchasing any services from Bayview Therapy.

5. Website Use

You agree to use our website only for lawful purposes and in a manner that does not infringe on the rights of others.

6. Intellectual Property

All content on the Bayview Therapy website — including text, graphics, logos, images, and software — is the property of Bayview Therapy or its content providers and is protected by copyright and intellectual property laws.
